Chief Justice denies motion for dismissal of impeachment…

MONROVIA, LIBERIA-Chief Justice Francis Korkpor has denied a motion for the dismissal of the ongoing impeachment trial filed by the defense team of Associate Justice Kabineh Ja’neh.

The defense team of Justice Ja’neh earlier filed a motion to dismiss the bill of impeachment against him on grounds that the bill is unconstitutional and contravenes Rule 63 of the Senate Standing Rules.

But Chief Justice Korkpor said:” I could not grant the dismissal motion as doing so would mean putting an end to the legislative proceeding.”

According to Chief Justice Korkpor, neither the Constitution nor the statutory law of Liberia gives him the authority to dismiss the impeachment trial.

Chief Justice Korkpor noted that the trial is been conducted by the Liberian Senate in which he has no vote or power to decide.

He added that a single justice cannot sit and decide constitutional issues under Liberian laws.

He explained that the same constitutional issues raised in the Writ of Prohibition filed by Justice Ja’neh’s legal team before the Supreme Court were similar issues raised in a re-petition filed by four senators concerning the impeachment.

Meanwhile, Associate Justice Kabineh Ja’neh has pleaded not guilty to charges of his impeachment as his legal team has filed a “Motion for Discovery.”
