Supreme Court reschedules legal arguments…..

by Fabine W. Kwiah

MONROVIA, LIBERIA-The Supreme Court of Liberia has rescheduled legal arguments based on the Congress for Democratic Change (CDC) Senatorial Candidate Alex Tyler’s appeal to the Court.

According to ELBC Judicial Reporter, the High Court postponed the hearing for next Tuesday, February 9, 2021, after the National Elections Commission (NEC) submitted incomplete records consistent with law.

The Court’s decision is based on an application filed by Mr. Tyler’s lawyer, Cllr. Amara Sheriff, which said that NEC’s minutes were inaccurate, and that minutes earlier submitted to them  is a sixty-three page document but the one submitted to the court contains fifty-one pages, indicating a difference of twelve pages.

Our reporter also said that during Thursday’s hearing, the Supreme Court fined the NEC one-hundred United States Dollars; while Tyler’s legal team was fined two-hundred United States Dollars for late submission of their respective legal briefs, to be paid in Government’s revenue within seventy-two hours.

Meanwhile, Chief Justice Francis Korkpor is calling on politicians to allow the Supreme Court carry out its statutory functions void of politics, because the court is not a political area.

Justice Korkpor’s remarks come in the wake of speculation that the Supreme Court’s rulings are often marked by unfairness.

He clarified that the High Court’s decisions are always in line with the laws of Liberia and not based on political influence.

Meanwhile, Chief Justice Korkpor observed that cases destined for the Supreme Court spend longer time at the National Elections Commission (NEC), and urged the Commission to speed up with such cases for early submission to the court and adjudication.

He spoke on Thursday, February 4, 2021, prior to legal proceeding into CDC Senatorial Candidate Alex Tyler’s appeal, seeking to overturn NEC Board of Commissioners’ verdict in favor of Independent Candidate Edwin Snowe.
