Lawyers Representing House of Rep. Majority Bloc Seeks Re-argument in Bill of Info…

by Fabine W. Kwiah

MONROVIA, LIBERIA-Lawyers representing the Majority Bloc of the House of Representatives have surfaced with a petition before the Supreme Court, seeking for re-argument in connection with the embattled House’s Bill of Information.

This follows the High Court’s April 23, 2025, judgement in favour of Cllr. Fonati Koffa, saying that he is the legitimate Speaker of the 55th National Legislature, and later mandated the Majority Bloc to operate by its interpretation of Articles 33 and 49 of the 1986 Constitution.

Though the Majority Bloc’s Speaker, Richard Koon, has since rejected the Supreme Court’s decision on the doctrine of “Separation of Powers”, and is seeking for re-argument consistent with Rule-Nine, Part-One of the Supreme Court.

The rule states: “For good cause shown to the Court by petition, a re-argument of a cause may be allowed only when some real substantial mistake is made by inadvertently overlooking some facts or point of law.”

It further states that, “A petition of rehearing shall be presented within three days after the filing of the opinion, unless in cases of special leave granted by the Court upon application and shall not be heard unless a justice concurring in the judgment shall order it.”

As a result of this provision, the Majority Bloc’s legal team, headed by Cllr. Varney Shaman has obtained one of the concurring justice signatures in person of Associate Justice Ceaineh Clinton-Johnson for the re-argument petition.

Cllr. Varney Sharman’s 29-count request to the Court, among other things, claimed that the Court inadvertently overlooked some facts and law during the proceedings and believed that their request for rehearing would unearth these errors to the Court.

ELBC Judicial Reporter said:” The Supreme Court has since confirmed the Majority Bloc’s petition for a new hearing, but no date has been announced for the re-hearing.”
