MONROVIA, LIBERIA-The Civil Law Court is expected to entertain legal arguments this Tuesday, November 8, 2021, on Circuit Judges’ application seeking to include the National Legislature as party to their previous action against the Government of Liberia over the slashing of salary.
This followed notices of assignment issued by Judge Kennedy Peabody to lawyers of both parties.
About four Circuit Judges filed a four count motion last month to add the National Legislature, as a party to their previous Petition for Declaratory Judgment.
The judges’ application cited Article 34(d) of the Constitution as their legal reliance for the inclusion of the lawmakers.
Article 34(d) empowers the National Legislature to make appropriations through the budget for the fiscal governance of the Country.
The judges also referenced the New Judiciary Law, which provides that salaries of judges, Judges and Stipendiary Magistrates, should be fixed by statute and provided by annual budgetary appropriation.
The Government, through the Justice Ministry, had earlier pleaded with the judges to resolve the matter without litigation
